For the purpose of residential properties a new Regulation No. 43293, Gazetted on the 7th of May 2020 has been passed, which now allows parties who entered into a sale transaction or a lease transaction before lockdown or a lease agreement during the lockdown, to move “once off”, during the 7th of May 2020 and 7th of June 2020.
Parties may further move over Provincial, Metropolitan and/or District boundaries, in which case a permit must be obtained from the South African Police Station.
It is important to note that during the move all relevant documentation as set out below needs to be available for inspection at all times:
- Offer to Purchase and confirmation from the conveyancer that the transfer has registered, if applicable.
- Lease Agreement and the old lease agreement indicating when same has lapsed, if possible.
It is further to be noted that the Offer to Purchase or Lease Agreement should reflect that occupation should have already been taken place or is eminent.
It is also noteworthy that the service of removal companies may be utilised to facilitate the move.
Parties who have been anxiously awaiting the relaxation of these restrictions should quickly enter into a discussion with related parties concerned, in order to reach a mutually acceptable date on which the move can take place.
